Ze komen op een moment waarop de Amerikaanse Securities and Exchange Commission (SEC) haar benadering van de cryptosector opnieuw tegen het licht houdt.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-peirce-verdedigt-open-source-blockchainsoftware\">Peirce verdedigt open-source blockchainsoftware<\/h2>\n<p>Volgens Peirce is het publiceren van open-source software fundamenteel iets anders dan het aanbieden van financi\u00eble diensten. Blockchainnetwerken draaien vaak op openbaar beschikbare code die door iedereen kan worden gebruikt, aangepast en gecontroleerd.<\/p>\n<p>\u201cVeel blockchainprojecten omvatten het publiceren van open-source software, wat over het algemeen een beschermde activiteit is onder het Eerste Amendement\u201d, aldus Peirce.<\/p>\n<p>Daarmee mengt zij zich in een belangrijk juridisch debat binnen de cryptosector. De centrale vraag is of ontwikkelaars verantwoordelijk kunnen worden gehouden voor activiteiten die plaatsvinden op protocollen die zij hebben gebouwd, maar niet controleren.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-defi-werkt-zonder-traditionele-tussenpersonen\">DeFi werkt zonder traditionele tussenpersonen<\/h2>\n<p>Peirce benadrukte dat DeFi-protocollen juist zijn ontworpen om zonder banken, brokers of andere centrale partijen te functioneren. Volgens haar zou de verantwoordelijkheid voor mogelijke overtredingen van de effectenwetgeving daarom moeten liggen bij de personen die daadwerkelijk de regels overtreden, en niet bij de ontwikkelaars van de onderliggende technologie.<\/p>\n<p>Voor de DeFi-sector kan dat een belangrijk signaal zijn. Ontwikkelaars kampen al jaren met juridische onzekerheid over hun rol binnen gedecentraliseerde ecosystemen.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-sec-zoekt-nieuwe-koers-voor-crypto\">SEC zoekt nieuwe koers voor crypto<\/h2>\n<p>De opmerkingen van Peirce sluiten aan bij het werk van de Crypto Task Force van de SEC. Deze werkgroep onderzoekt hoe bestaande effectenwetten moeten worden toegepast op digitale activa, blockchainnetwerken en gedecentraliseerde systemen.<\/p>\n<p>Ook recente richtlijnen van SEC-medewerkers wijzen op een mogelijke koerswijziging. Daarin staat dat bepaalde websites en software-interfaces die uitsluitend toegang bieden tot gedecentraliseerde protocollen mogelijk niet onder de traditionele definitie van een broker vallen.<\/p>\n<p>Dat voedt de verwachting dat de toezichthouder een duidelijker onderscheid wil maken tussen het bouwen van technologie en het aanbieden van financi\u00eble diensten.<\/p>\n<p>Tegelijk blijft blockchain hoog op de agenda van de SEC staan.
