Duitsland overweegt vanaf 2027 een ingrijpende hervorming van de belastingregels voor crypto. Daarmee dreigt een van de belangrijkste voordelen voor Duitse langetermijnbeleggers in crypto te verdwijnen. Wat zijn de Duitse plannen precies?<\/p>\n

Duitse belastingvrijstelling voor crypto onder druk<\/h2>\n

Minister van Financi\u00ebn Lars Klingbeil liet tijdens een presentatie<\/a> van de federale begroting weten dat Duitsland \u201ccryptocurrencies anders wil belasten\u201d. Daarbij mikt de regering op ongeveer 2 miljard euro aan extra belastinginkomsten uit de sector. Vooral de huidige belastingvrije holdingperiode van \u00e9\u00e9n jaar ligt onder vuur.<\/p>\n

Onder de huidige Duitse regels<\/a> betalen beleggers belasting wanneer zij crypto binnen twaalf maanden na aankoop verkopen. Worden de munten langer aangehouden, dan zijn winsten doorgaans belastingvrij. Die regeling maakte Duitsland de afgelopen jaren aantrekkelijk voor particuliere cryptobeleggers.<\/p>\n

Hoewel Klingbeil de regeling niet expliciet noemde, verwachten brancheorganisaties zoals de Duitse Bitcoin Association dat juist deze belastingvrije periode zal verdwijnen. Crypto-belastingexpert Robin Thatcher noemt dat een riskante stap. Volgens hem zou Duitsland daarmee \u201czijn aantrekkingskracht als crypto-hub aanzienlijk verzwakken\u201d.<\/p>\n

De discussie speelt bovendien op het moment dat Europa strengere cryptorapportage invoert via het DAC8-regime. Sinds januari moeten cryptobedrijven uitgebreide klant- en transactiegegevens delen met belastingautoriteiten binnen de Europese Unie.<\/p>\n

Ook Nederland op weg naar strengere belastingregels<\/h2>\n

De ontwikkelingen in Duitsland overlappen ook met een gevoelig debat in Nederland. Op dit moment vallen crypto\u2019s hier onder box 3, waarbij belasting wordt geheven over een fictief rendement op vermogen. Dat systeem staat al jaren onder druk na meerdere uitspraken van de Hoge Raad, die oordeelde dat de huidige aanpak in bepaalde gevallen onrechtmatig is.<\/p>\n

Het kabinet werkt daarom momenteel aan een nieuw box 3-stelsel<\/a> dat in 2028 moet ingaan. Daarbij wil de overheid overstappen naar een vermogensaanwasbelasting. Dat betekent dat beleggers jaarlijks belasting betalen over de daadwerkelijke waardestijging van hun vermogen, zelfs wanneer crypto-activa nog niet zijn verkocht.<\/p>\n

Juist dat onderdeel leidt tot veel kritiek vanuit beleggers, fiscalisten en ondernemers. Tegenstanders wijzen erop dat belasting moet worden betaald over papieren winsten, terwijl verliezen pas later verrekend kunnen worden. Ook bestaat er vrees voor extra administratieve lasten en complexe waarderingen van cryptoportefeuilles.<\/p>\n

De wetgeving rondom het nieuwe box 3-systeem is nog niet definitief. De Raad van State en verschillende belangenorganisaties hebben stevige kritiek<\/a> geuit op de uitvoerbaarheid van het plan. Daardoor is nog onzeker of het voorstel in de huidige vorm daadwerkelijk per 2028 ingevoerd wordt. De wet ligt al een tijdje in de Eerste Kamer.<\/p>\n<\/div>\n
